Medical Emergency Notice
IF YOU BELIEVE YOU ARE HAVING A MEDICAL EMERGENCY, IMMEDIATELY CALL YOUR LOCAL MEDICAL PROVIDER OR DIAL 9-1-1. Telehealth is contemplated only for specific, non-emergency medical conditions and concerns.

We understand the importance of confidentiality and privacy regarding your information. Please refer to our Privacy Policy for details on how we collect, use, and disclose information about you.
Introduction
Icon Medicine LLC owns and operates iconmedicine.com (the “Site”). Your use of the Site, any part thereof, or anything associated therewith, including the services, features, content, and applications (collectively, the “Services”), is offered by Icon Medicine LLC (“Icon Medicine”) and its affiliated Medical Groups and Providers. Any products or services provided through the Site or affiliated websites, software, or applications are governed by these Terms of Use (“Terms”).
By accessing or using any of the Services, you agree to be bound by these Terms. If you do not agree with these Terms or any referenced policies, you are expressly prohibited from using the Site and Services and must discontinue use immediately.
Agreement to Terms
These Terms constitute a legally binding agreement between you (“you”) and Icon Medicine. They govern your access to and use of the Site and Services, regardless of whether you access them through a third-party website or mobile application. By accessing the Site or Services, you confirm that you have read, understood, and agree to be bound by these Terms and any additional terms or policies referenced herein (collectively, “Additional Terms”).
- Non-Acceptance: If you do not agree with these Terms or Additional Terms, you must not use the Site or Services.
- Rejection of Conflicting Terms: Any additional, different, or conflicting terms you provide to Icon Medicine are rejected and inapplicable.
- Updates to Terms: Icon Medicine reserves the right to modify these Terms or Additional Terms at any time. Changes will be indicated by updating the “Last Updated” date. Continued use of the Site or Services after such changes constitutes acceptance of the revised Terms.
Requirements for Use
To use the Site, you must have:
- Compatible computing and/or mobile devices.
- Internet access.
- Necessary software.
- Fees and data charges may apply for internet usage.
Your Relationship with Icon Medicine
Icon Medicine does not provide medical services. The Services may facilitate access to professional medical organizations (“Medical Groups”) that employ or contract with licensed medical providers and clinicians (“Providers”) to offer healthcare services (“Healthcare Services”) via the Site.
- Provider Independence: Providers are independent practitioners contracted or employed by Medical Groups, solely responsible for the Healthcare Services provided.
- No Patient-Provider Relationship: Accessing the Site does not create a patient-provider relationship.
- Service Limitations: The Site is designed for specific Healthcare Services and is not a substitute for comprehensive medical advice, care, diagnosis, or treatment. Providers may determine that certain conditions require in-person visits or are unsuitable for telehealth.
- No Liability: Icon Medicine is not responsible or liable for any advice, treatment, diagnosis, or other services obtained through Providers or Medical Groups.
Healthcare Services are provided by Providers licensed in the state where you are located, using a HIPAA-compliant platform. Providers may diagnose conditions, prescribe medications (including controlled and non-controlled substances), or recommend alternative care based on their independent judgment.
Pharmacy Services
Icon Medicine is not a pharmacy and does not control pharmacy services. By agreeing to these Terms, you acknowledge that you may enter into relationships with pharmacies or related third parties for prescription fulfillment.
Electronic Communications
By accepting these Terms, you consent to receive disclosures, notices, messages, reports, and other communications from Icon Medicine electronically. You are responsible for monitoring these communications and maintaining copies (printed or electronic). Icon Medicine is not liable for losses resulting from your failure to read or comply with these communications.
Access Rights and Prohibited Use
The Site is hosted in the United States and is intended for users who are at least 18 years old or able to independently consent to Healthcare Services in their jurisdiction. Access from other jurisdictions is at your own risk, and you are responsible for compliance with local laws.
Prohibited Activities
You may not:
- Impersonate any person or entity.
- Sell tobacco products.
- Use the Site illegally or to commit illegal acts.
- Access the Site in jurisdictions where it is unauthorized.
- Conceal the identity, source, or destination of illegally gained money or products.
- Use automated tools (e.g., robots, spiders) to retrieve, index, or reproduce Site content.
- Collect usernames or email addresses for unsolicited communications.
- Interfere with or disrupt the Site or its servers.
- Transmit viruses or harmful code.
- Forge headers or manipulate identifiers to disguise the origin of transmitted information.
Icon Medicine reserves the right to investigate, suspend, or terminate your account for misuse or inappropriate behavior.
Your Protected Health Information (PHI)
The Site facilitates Healthcare Services by:
- Gathering and retaining healthcare records for Provider use.
- Providing administrative support for scheduling and payments.
- Coordinating prescription fulfillment and payment.
- Offering telecommunications support for Provider interactions.
Icon Medicine collects your information, including health conditions, medications, diagnostic tests, and personal details (collectively, “Your Information”), which may include Protected Health Information (PHI) under HIPAA. By using the Site, you consent to Icon Medicine sharing Your Information with Medical Groups, Providers, pharmacies, laboratories, and diagnostic companies to facilitate Healthcare Services.
- HIPAA Status: Icon Medicine is not a “Covered Entity” under HIPAA but may act as a “business associate” for certain entities. PHI is used and disclosed in accordance with applicable laws and our Privacy Policy.
- Non-Protected Information: Information not classified as PHI or protected under state laws may be used or disclosed per the Privacy Policy.
- Notice of Privacy Practices: By using the Services, you acknowledge receipt of the Medical Groups’ and Providers’ Notice of Privacy Practices.
User Representations
By using the Site, you represent and warrant that:
- All registration information is true, accurate, current, and complete.
- You will maintain and update registration information as needed.
- You have the legal capacity to comply with these Terms.
- You are at least 18 or able to consent to Healthcare Services in your jurisdiction.
- You will not access the Site through automated or non-human means.
- You will not use the Site for illegal or unauthorized purposes.
- Your use of the Site will not violate applicable laws or regulations.
Providing false or inaccurate information may result in account suspension or termination.
Proprietary Rights
Icon Medicine owns all proprietary rights in the Site and its content, trademarks, trade names, and service marks. You may not copy, modify, transmit, or create derivative works from any copyrighted material or intellectual property without prior written consent from Icon Medicine or the respective owner.
Copyright Policy
You may not post or reproduce copyrighted material without permission. To report copyright infringement, provide the following to Icon Medicine’s Copyright Agent at icon@iconmedicine.com or 10770 Columbia Pike, Ste 300, Silver Spring, MD 20901:
- Identification of the copyrighted work claimed to be infringed.
- Identification of the infringing material (e.g., URL).
- Your contact information (address, phone, email).
- A statement of good faith belief that the use is unauthorized.
- A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.
- Your electronic or physical signature.
Icon Medicine will terminate accounts of repeat infringers.
Modifications to Site or Services
Icon Medicine may modify or discontinue the Site or Services at any time without notice and is not liable for any resulting damages. Icon Medicine may also block users from certain IP addresses to protect the Site’s integrity.
Disclaimers
- The Site is provided “as is” and “as available” without warranties of any kind, including implied warranties of quality, merchantability, fitness for a particular purpose, or non-infringement.
- You access or download material at your own risk and are responsible for any resulting damage to your device or data.
- Third-party content on the Site is the responsibility of its authors. Icon Medicine does not guarantee its accuracy or reliability and is not liable for any loss or damage resulting from reliance on such content.
Links to Other Websites or Resources
The Site may contain third-party advertisements, promotions, or links to external websites or resources. Icon Medicine is not responsible for the availability, content, or reliability of these external resources, nor is it liable for any damages resulting from their use.
Limitation of Liability
To the fullest extent allowed by law, Icon Medicine, its Medical Groups, Providers, and affiliates are not liable for indirect, consequential, exemplary, or punitive damages, including loss of profits, goodwill, or data. Icon Medicine’s liability is limited to the amount you paid for the Services while you have an account. Any claims must be filed within one year of arising or be forever barred.
Governing Law
This Agreement is governed by the laws of the state of Iowa, without regard to conflict of law principles. Any disputes shall be resolved in Charles County District Court, LaPlata, Maryland, and you consent to this jurisdiction.
Indemnity
You agree to indemnify and hold Icon Medicine, its affiliates, Medical Groups, Providers, and their respective officers, directors, and employees harmless from any claims, liabilities, or demands arising from your breach of this Agreement, misuse of the Site, or violation of any law.
Notice
Icon Medicine may provide notices via email, regular mail, SMS, MMS, text messages, or Site postings. You are deemed to have received such notices if you access the Site in an authorized manner.
Payments
You agree to pay all fees for Services and Healthcare Services per the presented payment terms. Payments may include fees charged by Medical Groups, Providers, or pharmacies, which Icon Medicine collects on their behalf.
- Payment Authorization: By submitting payment information, you authorize Icon Medicine, its affiliates, or third-party processors to retain and use your credit card information for fees, including co-pays, deductibles, or missed appointments.
- Responsibility for Fees: You are responsible for all fees, including those charged by third-party healthcare organizations not covered by Icon Medicine.
- Subscription Services: Some Services may be offered on a subscription basis, with automatic recurring charges. You may cancel subscriptions by emailing icon@iconmedicine.com or contacting your Provider, subject to their policies.
- Non-Refundable: Except as specified in any return or refund policy, fees are non-refundable.
Termination
These Terms remain in effect as long as you use the Services. You may terminate by discontinuing use. Icon Medicine may terminate or suspend your access at any time for any reason, including violations of these Terms. Certain provisions (Disclaimers, Limitation of Liability, Indemnity, Governing Law, Entire Agreement, Assignment) survive termination.
Entire Agreement
These Terms, together with the Additional Terms, constitute the entire agreement between you and Icon Medicine regarding the Site. If any provision is invalid, the remainder remains in effect. Icon Medicine’s failure to enforce any right does not constitute a waiver. Your account is non-transferable, and rights terminate upon your death.
Assignment
You may not assign your rights under this Agreement. Icon Medicine may assign or transfer its rights or obligations to an affiliate or third party without consent.
