Please read these Terms & Conditions ("Terms") carefully before using the website at iconmedicine.com ("Site") or any services offered by Icon Medicine Family Practice ("Icon Medicine," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use our Site or services.
Medical Emergency Notice
Our telehealth platform is intended solely for specific, non-emergency medical conditions appropriate for virtual care. Icon Medicine is not an emergency service provider.
In the event of a medical emergency, you should:
- Call 911 or your local emergency services immediately
- Go to the nearest hospital emergency room
- Contact your primary care provider if clinically appropriate
Do not attempt to use our platform to address a life-threatening condition or emergency. Icon Medicine expressly disclaims any responsibility for outcomes resulting from using our services in an emergency situation.
Our Services
Icon Medicine Family Practice operates a HIPAA-compliant platform that facilitates access to independent, licensed healthcare providers and medical groups. Icon Medicine itself does not provide medical services directly. Instead, we connect patients with qualified, independently contracted providers who deliver healthcare services through our platform.
Services available through our platform include, but are not limited to:
- Telehealth consultations and virtual visits
- In-office primary care appointments (select locations)
- Medication-assisted treatment programs
- Weight management services
- Mental health consultations
- Men's health services
- Urgent care (non-emergency)
All clinical decisions are made by the independent licensed providers, not by Icon Medicine. The platform is available to patients in Maryland, Virginia, and Florida, subject to applicable state law and provider licensure.
User Eligibility
To use our Site and services, you must:
- Be at least 18 years of age, or otherwise be legally capable of providing your own consent for medical treatment under applicable state law
- Have a compatible device (smartphone, tablet, or computer) with a working camera and microphone for telehealth visits
- Have a reliable internet connection sufficient for video conferencing
- Be located within a state where our affiliated providers are licensed at the time of service (currently Maryland, Virginia, and Florida)
- Provide accurate and complete information when registering or booking appointments
By using our services, you represent and warrant that you meet all of the above eligibility requirements. If we discover that you do not meet these requirements, we reserve the right to suspend or terminate your access.
Prohibited Activities
When using iconmedicine.com or our services, you agree not to:
- Impersonate any person or entity, or falsely claim an affiliation with any person or entity
- Engage in any illegal or fraudulent activity, including obtaining prescription medications under false pretenses
- Use automated tools, bots, scrapers, or similar technologies to access or collect data from our Site without prior written consent
- Interfere with or disrupt the operation of our Site, servers, or networks
- Transmit any viruses, malware, or other malicious code
- Violate any applicable local, state, federal, or international law or regulation
- Harass, abuse, or harm another person through our platform
- Attempt to gain unauthorized access to any portion of the Site or any other accounts, systems, or networks connected to it
- Post or transmit content that is defamatory, obscene, fraudulent, or otherwise objectionable
- Use our platform for any commercial solicitation not expressly authorized in writing by Icon Medicine
Violation of these prohibitions may result in immediate termination of your access and may expose you to civil or criminal liability.
Protected Health Information
Icon Medicine handles Protected Health Information ("PHI") in accordance with the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and applicable state privacy laws.
By using our services and submitting health information through our platform, you expressly consent to Icon Medicine sharing your health information as necessary to facilitate your care, including sharing with:
- Your treating healthcare providers and their staff
- Pharmacies for prescription fulfillment
- Diagnostic laboratories and imaging companies
- Health insurance companies for billing and authorization
- Other healthcare providers involved in your coordinated care
We take the security of your health information seriously. Our platform uses industry-standard encryption and security protocols to protect PHI. Our full HIPAA-compliant privacy practices are described in our Privacy Policy and separately in our Notice of Privacy Practices, available upon request.
Payment Terms
By using our services, you agree to the following payment terms:
- You agree to pay all applicable service fees, co-pays, and charges associated with your appointments and services
- You authorize Icon Medicine and its affiliated providers to process payments through our secure payment processing systems
- Missed appointments may be subject to a cancellation or no-show fee as disclosed at time of booking. Please cancel at least 24 hours in advance to avoid charges
- Subscription services (where applicable) feature automatic recurring billing on your chosen billing cycle. Your subscription will renew automatically unless you cancel by sending written notice to icon@iconmedicine.com at least 48 hours before your renewal date
- All fees are due at the time of service unless other arrangements have been made in advance
- We accept major credit cards and other payment methods as displayed at checkout
- Insurance billing is available where applicable; patients are responsible for any amounts not covered by their insurance plan
If you dispute a charge, please contact us at icon@iconmedicine.com within 30 days of the charge. Chargebacks initiated without prior contact may result in suspension of your account.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
- The Site and all content, services, and materials are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied
- Icon Medicine does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components
- Icon Medicine makes no representations or warranties regarding the accuracy, completeness, or suitability of any content on the Site for any particular purpose
- Icon Medicine's total liability to you for any claim arising out of or relating to these Terms or your use of the Site shall not exceed the amount you paid to Icon Medicine in the three months preceding the claim
- In no event shall Icon Medicine be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or services
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
Note: Nothing in these Terms limits liability that cannot be excluded by law, including liability for gross negligence, fraud, or personal injury caused by negligence.
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of law principles.
Any disputes arising out of or relating to these Terms or your use of our services that cannot be resolved informally shall be brought exclusively in the District Court of Charles County, LaPlata, Maryland. You hereby consent to the personal jurisdiction and venue of such courts.
Before initiating any formal legal proceedings, you agree to attempt to resolve any dispute by contacting us at icon@iconmedicine.com and giving us a reasonable opportunity (at least 30 days) to address your concern.
Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. For significant changes, we may also provide notice via email or a prominent notice on the Site.
Your continued use of the Site after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, please discontinue use of our Site and services.
